Terms and Conditions
By participating in the Southeast Highland Cattle Auction,
I agree to the following:
I will sell under the suggested Terms and Conditions of the American Highland Cattle Association
I will not hold Southeast Highland Cattle LLC, Sale Ring Live, the Appalachian Fair, event organizers, volunteers, or any other individuals involved in the planning or execution of the auction responsible for any injury, loss, or accident that may occur during the event
I will promote my consigned animals only through the official sale listing link and will not offer them for private sale prior to the auction
I understand that if I sell an animal privately before the auction, I will not receive a refund and may be banned from future sales
I agree to the health requirements and will complete all necessary vet testing and provide current health papers before bringing animals to the event
Southeast Highland Cattle LLC reserves the right to refuse any entry that does not meet health, registration, breed, or conduct standards, or that is not in the best interest of the sale
I will follow all auction rules and policies. Misrepresentation of animals, unauthorized withdrawals, or other violations may result in removal from the sale and disqualification from future events

Breeding Guarantee and Registration Accuracy
All animals sold (unless otherwise stated) are guaranteed to be breeders, with the following exceptions:
A) Calves under 12 months of age
B) Animals shown by the purchaser after the sale (in such cases, any breeding guarantee is solely between buyer and seller)
C) Injury or disease occurring after the sale
D) Gross negligence or willful misconduct on the part of the purchaser
Females represented as “pregnant” have been examined by a licensed veterinarian and are guaranteed as such. Exposed females are not guaranteed to be in calf. Females sold as breeding animals are guaranteed not to be free-martins.
If a female sold as “pregnant” is found not to be in calf, the purchaser may be offered rebreeding to the original bull used, if that bull is still available. If the bull is not available, the seller must either make a satisfactory adjustment to the purchase price or, at the buyer’s option, refund the full purchase price upon return of the animal to the seller’s farm. Transportation costs are the responsibility of the buyer, unless return travel exceeds the distance between the buyer’s farm and the sale location—in which case the seller will cover the excess.
If a female is sold as bred to a specific bull but is later determined to have been bred to a different bull, the seller must make a satisfactory price adjustment or, at the buyer’s option, refund the full purchase price upon return of the animal.
If an animal is found through blood typing or DNA testing to have different parentage than listed on its registration papers, the buyer is entitled to a full refund upon return of the animal to the seller’s farm at the buyer’s expense. The buyer may instead choose to exchange the animal for one of equal value, or, if both parties agree, the seller may correct the registration certificate at their own expense. Any adjustment made under this policy releases the seller from further liability regarding pedigree accuracy.
Cows with calves at side are presumed to be breeders with no further fertility guarantee.
Any controversy or claim arising out of or related to this contract, or the breach of it, shall be settled by arbitration administered by the American Arbitration Association under its commercial arbitration rules. Judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction.
